MIAMs Don’t Last Forever

I don’t archive files until at least 4 months has passed from the end of a mediation, the reason being that the mediator can validly sign the court from within that timescale.

Whilst I point out to clients who don’t have a solicitor that there is a time limit, I don’t to their solicitors as I assume that they know. However I’ve just been asked for a signature way outside the time limit so felt it might help to post a reminder. Use it or lose it I’m afraid. It’s like a game of snakes and ladders where your client tumbles right back down a long snake and has to have another MIAM referral just when he or she has decided to crack on with an application to court.
